Is my non-compete agreement enforceable?
In Ohio, and Kentucky, and most states, non-compete agreements are generally enforceable to the extent that they’re reasonable. We get a lot of calls from employees who have had from some place, that the non-compete agreement they’ve signed isn’t enforceable.
In Ohio, that’s not necessarily true. It depends on whether it’s reasonable with respect to the time of the non-compete, the duration of it, and the area, or the distance of the non-compete.
You won’t know for sure if your non-compete agreement is enforceable, until you’ve talked with an experienced employment lawyer who can review the non-compete, talk with you in detail about what you do for your current employer, or what you did for your past employer, and then can give you an opinion about whether or not that particular non-compete agreement is enforceable.
