Can I be fired while I’m off work for an injury?

If you’re fired when you’re off work for an injury, you may have a claim for illegal employment discrimination. It depends. You may be eligible for the FMLA. If you are, and you still have time left under your twelve-week allotment, and you’re fired that could be a violation of the FMLA.

Also, if you were fired because you filed a Workers’ Compensation claim that may be illegal as well.

If you’re fired while you’re off work for an injury, you should certainly consult an employment lawyer, talk about your situation, and get some guidance about whether or not you may have been illegally terminated.
