    Discrimination

The law protects you from discrimination in the workforce based on such things as disability, gender, age, race, and religion. If you have been terminated or mistreated because of one of these characteristics, you may have a case against your employer. We walk our clients through their rights so that they know what kind of protection they can expect from the law. Our employment lawyers have successfully represented many clients through their employment discrimination dispute cases, whether resolved by mediation and settlement or by taking them to trial before a jury.

    Sexual Harassment

If you think that you are being sexually harassed at work, chances are that you are right. Trust your intuition; you know if something seems inappropriate or not. Sexual harassment includes any unwelcome sexual advance, conduct, or request for sexual favors that occurs in the workplace. This can also include inappropriate and offensive jokes made about one’s sex. If a coworker, employer, or someone else in your work environment is making you uncomfortable due to conduct of a sexual nature, you have a right to demand that it stop, and you may have grounds for a sexual harassment claim.

    Whistleblower Law

The fact is that whistleblower protection law is complex and not always intuitive. When deliberating whether the risk of losing a job outweighs the benefits of taking corrective action and reporting broken laws, employees may feel they face an insurmountable task. It is unfortunate that this should even have to be a concern for you. By consulting a Cincinnati attorney experienced with whistleblower issues, you will be able to proceed confidently during what can be a very intimidating process.

    FMLA

If you work for a company with over 50 employees within a 75 mile radius of where you work, you may be eligible for FMLA if you have been with them for at least one year. Under the FMLA, or Family and Medical Leave Act, you qualify for unpaid, job-secured leave for certain circumstances, like when you have a baby or when you or a family member has serious health problems. If you believe you have been denied leave when you should rightfully be allowed it, or if you have been retaliated against or punished for taking or applying for FMLA leave, the employment attorneys at Robert A. Klingler, Co., L.P.A. can explain whether or not you have a claim and can protect your rights.

    Before You Call Us

If you do not have a written employment contract, you are an “at will” employee. That means you do NOT have a claim for wrongful termination unless you were terminated for an UNLAWFUL reason. There are only a few UNLAWFUL REASONS:

    1. Termination because you are disabled
    2. Termination because of your sex or gender, and perhaps gender orientation
    3. Termination because of your age (over 40)
    4. Termination because of your race or national origin
    5. Termination because of your religion
    6. Termination because you requested or took FMLA leave
    7. Termination because you complained about harassment related to any of the above
    8. Termination because you complained about a clearly illegal or unsafe condition

Representing Your Interests in Employment and Business Litigation

Our firm has many years of experience with business litigation, including shareholder, close corporation, and partnership disputes. We apply thorough and creative legal analysis and mature judgment to each case in an effort to achieve client goals cost effectively. Our size and efficiency result in fees that are usually substantially less than large-firm fees, with no compromise in the quality of results.

We have assisted clients in litigation involving claims against former lawyers, against trustees of trusts, current and former business partners, banks and other lenders, stock brokers, financial advisors, and others. These disputes are often resolved short of actual litigation, through mediation or other negotiations. But if litigation is necessary, we are prepared to litigate the case aggressively and efficiently to obtain the best achievable result for our clients.

The level of success our cases have seen in the courtroom would not be achievable if we did not enjoy what we do. Our passion comes out in our work. We apply this passion, along with our attention to detail and high quality service, to each of our clients’ cases. No two cases are alike; therefore, we customize our approach for every person who walks through our door. We realize that your employment dispute may affect your livelihood and therefore your family as well. You need someone who will have your best interests in mind from beginning to end. Our team will do that. Contact us today to see how we can help you.
